Overview and Use of this Website

This on-line service is intended for frequent users of our catering services. Those unfamiliar with the services and products offered are encouraged to work with one of our qualified sales consultants for order placement other than Box Lunches. The submission of your order signifies your acceptance of this Agreement. Requests for services and/or products are reviewed hourly during our normal hours of operation, but shall be considered “Pending” and not binding on Metropolitan Market until “Accepted” by a Metropolitan Market staff member. Once the status of your order changes from "Pending" to "Accepted" you have a confirmed order. Requests for services are accepted on a space available basis. To avoid disappointment, please plan early. Under most circumstances, orders for catering platters can be accommodated with 24 hours notice. Orders for Box Lunches should be placed prior to the close of business the day prior to your event. During peak holiday periods more advance notice may be necessary. Menu Items, prices and services are subject to change without notice. We strive to insure that this website contains accurate and current information. Nevertheless, certain information may become outdated or inaccurate, and by your accepting this Agreement, you hereby agree to hold Metropolitan Market harmless in connection with any errors or inaccurate information appearing on this website.

Revisions to Accepted Orders

1. Payment/Billing Procedure

Generally payment is due upon receipt of services or products. A 50% deposit is required to secure orders over $500.00 and said deposit shall be non-refundable if the order is cancelled with less than 48 hours notice. Additional charges may be incurred for order modifications with less than 48 hours notice. All of the costs will be due in full on orders canceled with less than 12 hours notice, regardless of the size of the order. Orders scheduled for pick-up at a location other than our Catering office located in our Uptown store must be paid in advance. Advance payments are most frequently accomplished with the use of a credit card.

2. Payment Types

Credit Cards
We accept Visa, Master Card, American Express, and Discover Card. Generally, credit card payments are not processed until the day the goods and/or services are provided. The charge will be listed as “Metropolitan Market” on your credit card statement.

Checks
If you elect to pay by check, please make your check payable to “Catering by Metropolitan Market.” Please include your name and order# on the check. Payments may also be made in person at the Catering office during normal business hours of 7:00am - 7:00pm weekdays and 9:00am-5:00pm weekends and most holidays. You will be charged a fee of $30.00 for checks returned due to non-sufficient funds (NSF).

Payment On Delivery
Payment On Delivery You may pay for the goods and/or services by check upon your receipt of the goods and/or services. All orders not paid when due shall accrue interest at the rate of twelve percent (12%) per annum, or the highest rate allowed by law.

3. Deliveries

We deliver to your office. Unless otherwise indicated, set up and service staff is not included as part of your order. If you would like these services, please speak to your sales consultant about the cost and availability of these services. Deliveries generally arrive at or before the scheduled delivery time. Catering Delivery Order totals under the minimum order requirement (presently $40.00) will incur a surcharge presently $5.00. Please see Gift Basket Delivery details below.

Standard Delivery Window
7:30 AM to 3PM ”Standard” deliveries generally arrive prior to the requested delivery time, but not more than ninety (90) minutes prior to the requested delivery time. Standard Delivery Window is free within our local zip code delivery area.

Executive Express Delivery
“Executive Express” deliveries will arrive no more than thirty (30) minutes prior to the requested delivery time. Executive Express Delivery is $29.00, additional delivery charges may apply.

Hot Food Deliveries
Customers choosing to have their food delivered hot may pay an additional fee. Otherwise, most items are fully cooked and ready to reheat and enjoy. Gift Basket Delivery Window Select from three delivery times. 8AM to 1 PM window or 12PM to 5PM window is $15.00 charge. An all day window from 8AM to 5PM is $10.00 charge.

Due to conditions beyond our control, we can not guarantee a delay will not occur.

4. Customer Pick-Ups

Orders can be picked up from our Catering office located in our Uptown store, unless otherwise requested and noted on the order. Our Uptown store is located at 100 Mercer St., Seattle, WA 98109. The Catering office is located at the front of the store.

5. Revisions to Accepted Orders

You may revise an Accepted order by calling 206.343.8646 during normal business hours of 7:00am - 6:00pm weekdays, 9:00am-3:00pm Saturday & 9:00am- 1:00pm Sunday and most holidays. Please allow a minimum of 48 hours for any modification to your order. You may request a faxed confirmation of your revised order. Loss of deposit and/or additional charges may result from revisions and/or cancellations with less than 48 hours notice. You shall be liable for the full cost of the order if you cancel the order within 12 hours of the scheduled delivery or pick-up.

6. Alcoholic Beverages

A person at least 21 years of age must pick-up or accept the delivery of any orders including alcoholic beverages. The person who receives the delivery must be the same person who purchased the product. Valid identification will be required. Alcoholic beverages cannot be included in gift baskets delivered to a person other than the purchaser.

7. Rental Items

If your order contains rental items, the rental items must be returned to our Catering office located in our Uptown store the day after the event. If you prefer, we can arrange, for an additional charge, to have the rental items retrieved from the location to which they delivered. Additional charges will result from items returned late, damaged and returned heavily soiled or missing. Rental fees listed are for one days rental unless otherwise noted.

8. Safe Food Handling

Cold food items must be stored at a temperature below 40 degrees Fahrenheit and hot food items must be stored at a temperature above 140 degrees Fahrenheit. Discard any food item that has been stored for more than two hours outside of the above recommended temperature ranges. Items should never be saved for use at another time.

9. Return Policy

Replacement of items received in unsatisfactory condition
If a “perishable item” is delivered in unsatisfactory condition, you must submit your request for return or replacement of such item within 24 hours of your receipt of the item. In case of all other items received in unsatisfactory condition, you must request the return or replacement of such items within 48 hours of your receipt of the items. There are no extra shipping charges for the delivery of replacement items.

Failure of 3rd Party courier to deliver the order
Any 3rd party courier (e.g., UPS) delivering our Gift Baskets will make three (3) delivery attempts. If the delivery attempts fail because you or the recipient is not available to receive the delivery, you will still be charged for the order. However, if the delivery fails through no fault of the customer/recipient, you may request a refund for the cost of the undelivered goods.

Failure of Catering by Metropolitan Market to deliver the order
For orders delivered by Catering by Metropolitan Market, we will make two (2) delivery attempts. If for any reason you are unable to accept the delivery upon the arrival of our delivery person, we may reschedule your delivery at the time of our choosing. If both delivery attempts fail because you or the recipient is not available to receive the delivery, you will still be charged for the order. However, if the delivery fails through no fault of the customer/recipient, you may request a refund for the cost of the undelivered goods.

Cancelled orders
Any orders that are timely cancelled and approved will be refunded in full.

10. Release and Waiver

UNLESS THE METROPOLITAN MARKET (“COMPANY”) IS FOUND TO BE GROSSLY NEGLIGENT, THE COMPANY SHALL NOT BE RESPONSIBLE OR LIABLE TO CUSTOMER OR ANY THIRD PARTY FOR ANY ECONOMIC LOSS, PHYSICAL HARM, INCIDENTAL, CONSEQUENTIAL OR SPECIAL DAMAGES (INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS AND/OR LOSS OF BUSINESS OPPORTUNITIES) ARISING OUT OF ANY INFORMATION OR MATERIALS SUPPLIED BY THE COMPANY TO THE CUSTOMER, OR FOR ANY CLAIMS, DEMANDS OR SUITS WHICH RESULT FROM OR RELATE TO THE COMPANY’S MANUFACTURE, PACKAGING, DELIVERY OR SALE OF GOODS OR SERVICES.

11. Corporate Authorization

Any individual “Accepting” this Agreement on behalf of a corporation, limited liability company, partnership or other business entity (collectively referred to as “company”), represents and warrants that s/he is duly authorized to accept this Agreement on behalf of said company in accordance with a duly adopted resolution and that this Agreement is binding upon said company.

12. Security and Privacy

Metropolitan Market takes every precaution to protect information you send to us over the Internet. When you submit sensitive information via the website, we protect your information both online and offline. All personal information (such as name, address, credit card number, etc.) entered on our registration and order forms is transmitted in an encrypted form for your safety. All transactions are kept secure when you use Netscape Navigator 6.0+, Microsoft Internet Explorer 5.0+ or any compatible Secure Sockets Layer (SSL) browser to order our products and services.

Customers are advised not to enter their credit card details in a place other than in the secured payment page. We will never request your credit card information via-email. We will contact you if there are difficulties processing your credit card for payment. For your security, you may request to call us back at our published phone number of 206.343.8646.

While we use SSL encryption to protect sensitive information online, we also do everything within our power to protect your information offline. All of our users’ information -- not just the sensitive information mentioned above -- is protected by physical security measures and managerial controls to safeguard and secure the information we collect

13. Miscellaneous

Law
This Agreement shall be construed in accordance with the laws of the State of Washington. All claims and disputes between the parties relating in any way to this Agreement or its performance, interpretation, validity, or breach, or to any subject matter mentioned or contemplated in this Agreement shall be submitted to mediation in King County, Washington upon the application of either party. In the event of suit after mediation, Customer agrees that the District Court of King County, or in the alternative, the Superior Court of King County, shall have jurisdiction over any dispute or claim and venue shall be in King County, Washington.

Paragraph Headings
The paragraph headings are for convenience only and in no way define, limit, extend or interpret the scope of this Agreement or of any particular paragraph hereof.

Unavoidable Circumstances.
Metropolitan Market shall not be deemed to be in breach or in violation of this Agreement if it is prevented from performing any of its obligations hereunder for any reason beyond its reasonable control including and without limitation acts of God, riots, strikes, fires, storms, public disturbances, or any regulation of any federal, state or local government or any agency thereof.

Validity.
In case any term of this Agreement shall be invalid, illegal, or unenforceable, in whole or in part, the validity of any of the other terms of this Agreement shall not in any way be affected thereby.
